Overview of Criminal Defense Section

187 (a) Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.

192 Manslaughter is the unlawful killing of a human being without malice.

245 (a) (1) Any person who commits an assault upon the person of another with a deadly weapon or instrument other than a firearm

245 (a) (4) Any person who commits an assault upon the person of another by any means of force likely to produce great bodily injury

211 Robbery is the felonious taking of personal property in the possession of another, from his person or immediate presence, and against his will, accomplished by means of force or fear.

459 Every person who enters a home for the purpose of committing grand or petit larceny is guilty of burglary.

459.5 Shoplifting is defined as entering a commercial establishment with intent to commit larceny while that establishment is open during regular business hours, where the value of the property that is taken or intended to be taken does not exceed nine hundred fifty dollars ($950)
